These Terms of Service ("Terms") govern your access to and use of Snapopa's website, API, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
Please read these Terms carefully before using our Service.
1. Acceptance of Terms
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, you may not use the Service.
2. Description of Service
Snapopa provides a cloud-based API for:
- Capturing screenshots of websites
- Generating PDF documents from web pages
- Extracting metadata from web content
We may modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.
3. Account Registration
Requirements
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly update your account information if it changes
- Accept responsibility for all activities under your account
API Keys
You are responsible for all API calls made using your API keys. Keep your API keys confidential. If you believe your API key has been compromised, regenerate it immediately through your dashboard.
4. Acceptable Use
Permitted Uses
You may use the Service for lawful purposes in accordance with these Terms, including:
- Generating screenshots for your applications
- Creating PDF reports and documents
- Extracting metadata for content analysis
Prohibited Uses
You agree NOT to use the Service to:
- Violate Laws: Engage in any activity that violates applicable laws or regulations
- Abuse Resources: Attempt to overwhelm, disable, or impair our infrastructure
- Unauthorized Access: Access websites or systems without proper authorization
- Scrape Maliciously: Capture content from websites in violation of their terms of service
- Distribute Malware: Capture or distribute malicious content
- Infringe Rights: Capture copyrighted content for redistribution without authorization
- Circumvent Security: Bypass rate limits, authentication, or other security measures
- Resell Without Authorization: Resell the Service without our written consent
- Harm Minors: Use the Service to capture inappropriate content involving minors
- Spam or Phishing: Use captured screenshots for spam, phishing, or fraudulent purposes
We reserve the right to suspend or terminate accounts that violate these restrictions.
5. Subscription and Billing
Plans and Pricing
We offer various subscription plans with different usage limits and features. Current pricing is available at snapopa.com. Prices are subject to change with 30 days' notice.
Billing
- Subscriptions are billed in advance on a monthly or annual basis
- All fees are non-refundable except as required by law or stated in these Terms
- You authorize us to charge your payment method for all applicable fees
- Failed payments may result in service suspension
Usage Limits
Each plan includes a monthly API quota. Usage beyond your quota may result in:
- Requests being rate-limited or rejected
- Overage charges as specified in your plan
- Upgrade prompts to a higher tier
Free Tier
Our free tier is provided for testing and limited use. We reserve the right to modify or discontinue the free tier at any time.
6. Intellectual Property
Our Rights
The Service, including its design, features, and content, is owned by Snapopa and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service.
Your Rights
You retain ownership of content you capture through the Service. However, you are responsible for ensuring you have the right to capture such content.
License to Use
We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms and your subscription plan.
7. Captured Content
Your Responsibility
You are solely responsible for:
- The websites you choose to capture
- Compliance with those websites' terms of service
- Any legal issues arising from the content you capture
Content Storage
Captured screenshots and PDFs are stored according to your plan's retention settings. We may delete content from inactive accounts or accounts that exceed storage limits.
No Monitoring
We do not actively monitor the content you capture. However, we may review content if we receive complaints or detect potential violations.
8. API Usage
Rate Limits
API requests are subject to rate limits based on your plan. Exceeding these limits may result in throttling or temporary suspension.
Authentication
All API requests must be authenticated with a valid API key. Sharing API keys is prohibited.
SLA
Paid plans include our Service Level Agreement, with uptime measured and published at status.snapopa.com. The free tier has no SLA guarantees.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- UNINTERRUPTED OR ERROR-FREE OPERATION
We do not guarantee that:
- The Service will meet your specific requirements
- Screenshots will be pixel-perfect for all websites
- All websites can be captured successfully
- The Service will be available 100% of the time
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- These limitations apply regardless of the theory of liability
This limitation does not apply where prohibited by law.
11. Indemnification
You agree to indemnify and hold harmless Snapopa and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you capture through the Service
12. Termination
By You
You may cancel your subscription at any time through your dashboard. Cancellation takes effect at the end of your current billing period.
By Us
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Fail to pay applicable fees
- Abuse the Service
We will provide reasonable notice when possible, but may act immediately for serious violations.
Effect of Termination
Upon termination:
- Your access to the Service will cease
- Your API keys will be deactivated
- Stored content may be deleted after 30 days
- Outstanding fees remain due
13. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or dashboard notification at least 30 days before they take effect.
Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
14. General Provisions
Governing Law
These Terms are governed by the laws of the jurisdiction where Snapopa is incorporated, without regard to conflict of law principles.
Dispute Resolution
Any disputes shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property violations.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Snapopa regarding the Service.
Severability
If any provision is found unenforceable, the remaining provisions remain in effect.
No Waiver
Our failure to enforce any provision does not waive our right to enforce it later.
Assignment
You may not assign your rights under these Terms. We may assign our rights to any successor or affiliate.
